of EkoBIT Praha s.r.o.

1.Introductory Provisions

1.1The company EkoBIT Praha s.r.o., IČO: 21380414, with its registered office at Peroutkova 531/81, 158 00 Praha 5 – Jinonice, registered in the commercial register maintained by the Municipal Court in Prague, section C, file 401100 (hereinafter referred to as "EkoBIT"), as the administrator of personal data, fully respects the right to privacy of its clients (hereinafter also referred to as the "data subject") and related rights and therefore accepted these personal data processing principles.

1.2This personal data processing policy presents information for EkoBIT clients about the manner and extent of processing of personal data by EkoBIT, including the extent of rights of data subjects related to the processing of their personal data by EkoBIT.

1.3EkoBIT processes personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons in connection with the processing of personal data and on the free movement of such data and on the repeal of Directive 95/46/EC (General Data Protection Regulation), as amended (hereinafter referred to as the "Regulation") and further in accordance with the relevant national legislation in force in the field of personal data protection.

2.Definition of processed personal data

2.1EkoBIT processes in particular, but not exclusively, the following personal data:

  • a)identification and address data (name, surname, date of birth, social security number, address of permanent or other residence, in the case of a natural person entrepreneur, company name, VAT number and ID number, registered office, place of business),
  • b)contact data (contact or billing address provided by the client, telephone or fax number, e-mail address, or other contact information provided by the client),
  • c)other personal data (e.g. socio-demographic data, data on personal preferences and behavior or location data including IP or URL address).

2.2EkoBIT does not process special categories of personal data (ie sensitive data).

2.3EkoBIT processes personal data only in accordance with the purposes listed below and to the extent and for the time necessary to fulfill these stated purposes.

2.4The data subject is obliged to provide EkoBIT with only true and accurate personal data. The data subject is responsible for the correctness, accuracy and truthfulness of personal data. EkoBIT is not responsible for the correctness of the personal data provided.

3.Purposes of personal data processing and their legal titles

3.1EkoBIT processes personal data of clients mainly, but not exclusively, for the following purposes:

  • a)Delivery and provision and realization of the ordered software products, goods or services, including operation/maintenance service for the software product (hereinafter referred to as the "product")
    • In this case, the processing of personal data is necessary for negotiating the conclusion or amendment of a contract to which the data subject is a contracting party, and for the subsequent performance of such contract and invoicing of the delivered products.
    • In the case of creating an order, EkoBIT collects and processes the personal data of the data subject in the scope – name, surname, address, date of birth, telephone number, e-mail address. The communication of this personal data by the data subject is a basic prerequisite for the conclusion or amendment of the relevant contract, while the provision of personal data here serves primarily for the unambiguous and unmistakable identification of the data subject, or for contacting him.
    • Furthermore, in connection with the provision of its products, EkoBIT may process the data subject's personal data to the extent that results from a specific contract or the law (e.g. in the case of the need to personalize the order, profile data of the data subject), during the administration and creation of user accounts on the website, the use of web applications, etc.
  • b)Protection of EkoBIT's rights in the event of a dispute with the client
    • EkoBIT is also entitled to process the above range of personal data for the purpose of protecting its rights in the event of a dispute with the client.
  • c)Creation and registration of business opportunities and business communication
    • The above-mentioned personal data is further processed by EkoBIT as part of the creation and registration of business opportunities and for the implementation of business communication.
  • d)Client identification
    • In this case, personal data is processed to the extent of – name, surname, permanent or other residence, social security number or date of birth, type and number of identity card, state, or the authority that issued it, and its validity period, and is necessary to fulfill the legal obligation of EkoBIT when paying in cash above the limit set by Act No. 253/2008 Coll., on certain measures against the legalization of proceeds from criminal activities and the financing of terrorism, as amended.
  • e)Sending business communications, including EkoBIT product offers and information about organized marketing or other events via electronic means, especially e-mail, SMS messages, telemarketing, in accordance with Act No. 480/2004 Coll., on certain information society services, as amended.
    • In this case, EkoBIT collects and processes personal data of data subjects in the scope of name, surname, date of birth, address, telephone number, e-mail address, nationality, and only on the basis of voluntarily granted consent to the processing of personal data. This consent to the processing of personal data can be revoked by the data subject at any time by written notification delivered to EkoBIT via the contact details below. Revocation of consent does not affect the legality of processing based on consent prior to its revocation. The withdrawal of consent does not affect the processing of personal data that EkoBIT processes on the basis of a legal title other than consent (e.g. fulfillment of a contract or legal obligation).

4.Security and access to personal data

4.1EkoBIT uses all necessary technical and organizational measures to ensure the security and confidentiality of all data subjects' personal data, in particular to prevent unauthorized or accidental access to such data, their alteration, destruction or loss, unauthorized provision or transmission, as well as their other unauthorized processing or misuse.

4.2In addition to EkoBIT and its authorized employees, personal data may also be processed by EkoBIT's business partners External partners who, as processors, may process the data subject's personal data, EkoBIT carefully selects and entrusts personal data only to those who provide sufficient guarantees of ensuring appropriate technical and organizational measures to ensure the security of personal data.

4.3Other entities that may have access to clients' personal data are, or may be in the future, in particular, but not exclusively:

  • a)persons who ensure the technical operation of a certain product or service for EkoBIT or technology operators that EkoBIT uses for these products or services;
  • b)persons to whom EkoBIT provides data for the purpose of analyzing and measuring sales activities;
  • c)persons who provide EkoBIT with some services related to the provision of EkoBIT products and services or the sending of commercial communications;
  • d)business partners who participate in the organization of social and marketing events of EkoBIT;
  • e)law firm for the purpose of collecting EkoBIT claims.

4.4EkoBIT is also obliged to transfer certain personal data on the basis of valid legal regulations, in particular to state administration bodies, courts, law enforcement authorities in connection with possible administrative, criminal or civil proceedings.

5.Time of personal data processing

5.1EkoBIT processes personal data for the duration of the contractual relationship and for the time necessary to ensure mutual rights and obligations arising from the contract.

5.2In case of fulfillment of legal obligations, EkoBIT processes personal data for the period specified by the relevant legal regulations.

5.3In the event that EkoBIT processes personal data based on the consent of the data subject, the personal data is processed for the period specified in the consent, or until the withdrawal of consent by the data subject.

6.Rights of the data subject in relation to the processing of personal data by EkoBIT

6.1In relation to personal data, the data subject has the following rights:

  • a)the right to withdraw your consent to the processing of personal data at any time (if the processing is based on consent);
  • b)the right to access personal data (the right to request information as to whether or not personal data relating to the data subject is being processed by EkoBIT, and if so, the data subject has the right to obtain access to this personal data and to other information pursuant to Article 15 of the Regulation);
  • c)the right to data portability (the right to receive personal data relating to the data subject in a structured, commonly used and machine-readable format, and the right to transfer this data to another controller; and also the right to have personal data transferred directly from one controller to another controller, if technically feasible);
  • d)the right to rectification (the right to demand that EkoBIT correct inaccurate personal data concerning the data subject without undue delay);
  • e)the right to restrict processing (the right to request that EkoBIT restrict processing, e.g. if, due to the exercise of the right to correction, EkoBIT verifies the correctness of the data; or if EkoBIT has processed personal data unlawfully, but the data subject does not want to delete them);
  • f)the right to erasure (the right to demand that EkoBIT delete the personal data of the data subject without undue delay, i.a. if the personal data are no longer needed for the purposes for which they were collected, or the data subject revoked the consent on the basis of which the personal data was processed by EkoBIT and there is no other legal title for the processing, or if the personal data were processed unlawfully by EkoBIT);
  • d)the right to object to processing;
  • h)the right to contact the Office for Personal Data Protection with your initiative. has chosen a different payment option than paying for the goods upon receipt, the delivery period starts to run only after full payment of the purchase price, i.e. when the relevant amount is credited to the Seller's account.

7.Cookies and Google Analytics

7.1EkoBIT uses so-called cookies as part of its activity. Cookies are short text files that the server places on the user's computer when a website is loaded. Technically, it is a series of codes according to which the browser collects and then sends information about the user's behavior back to the relevant server. Cookies serve to set the content of the website according to the user's preferences, optimize the use of the website and increase user comfort, and to obtain information about the use of the service and user activities for their further analysis. This information helps to improve the structure and content of the EkoBIT website

7.2Each user can reject cookies using their web browser or set the use of only some cookies. However, restricting the use of cookies may affect some functions that are important for the optimal functioning of the website and may thus lead to a deterioration in user comfort.

7.3As part of its activity, EkoBIT also uses other services, such as Google Analytics (this is website analysis), which enables the acquisition of statistical data about website users, in particular the measurement of current and historical traffic and the behavior of website users and their characteristics. The goal of this analysis is to collect a sufficient amount of data in order to take measures to optimize the effectiveness of the web presentation.

7.4However, personal data are collected and processed only in anonymized form without the possibility of unambiguous identification of the data subject in the above-mentioned ways.

9.Final provisions

9.1The rights and obligations not regulated by these personal data processing principles are governed by the regulation and relevant national legislation in force in the field of personal data protection.

9.2These principles of personal data processing are publicly available on the EkoBIT website www. ekobit.cz The data subject is familiarized with these principles of personal data processing when concluding a contract or providing a service.

9.3EkoBIT reserves the right to change this personal data processing policy. The updated wording is always published on the EkoBIT website www.ekobit.cz indicating the effective date of such change.

9.4These principles of personal data processing become valid and effective on January 6, 2021.
